Adults - Ages 18 and up

If you have never been licensed you must go to a Driver's License Examiner and:

  • Present acceptable proof of identity 
  • Not be canceled, suspended, or revoked in any state 
  • Pass a vision examination 
  • Pass all applicable written examination(s) 
  • Pass driving examination (vehicle provided by you) 
  • Pay applicable fees 

Please Note: An out-of-state license is acceptble as as second form of ID, but not as proof of your legal name and date of birth. You will have to provide the legal documents as outlined under www.ksrevenue.org/dmvproof.htm  . Visit the National Center for Health Statistics at www.cdc.gov/nchs/howto/w2w/w2welcom.htm for information on obtaining birth certificates, marriage licenses, and divorce decrees from each state.

If you have a valid out-of-state license you can go to the Renewal Station at Treasurer’s Office and:

  • Present acceptable proof of identity 
  • Not be canceled, suspended, or revoked in any state 
  • Pass a vision examination 
  • Pay applicable fees

If you have an out-of-state license (expired 1 year or less) you can got to the Renewal Station at the Treasurer’s Office and:

  • Present acceptable proof of identity 
  • Not be canceled, suspended, or revoked in any state 
  • Pass a vision examination 
  • Pass all applicable written examination(s) 
  • Pay applicable fees

If you have an out-of-state license (expired over 1 year) you must go to an Exam Station and:

  • Present acceptable proof of identity 
  • Not be canceled, suspended, or revoked in any state 
  • Pass a vision examination 
  • Pass all applicable written examination(s) 
  • Pass  driving examination (vehicle provided by you) 
  • Pay applicable fees 

If you have a valid Kansas or out-of-state CDL license you must go to an Exam Station.

Graduated Driver License Requirements For Teen Drivers

Guidelines for Parents and Guardians of Teen Drivers

From the GDL (Graduated Driver License) Bill (HB 2143)"any person who held any valid restricted Class C or Class M driver's license, instruction permit, restricted instruction permit or farm permit on the effective date of this act may continue to operate motor vehicles subject to the conditions, limitations and restrictions contained in KSA 8-237, 8-239 and 8-296. and amendments thereto, as in effect on December 31, 2009."

To correctly determine how the Graduated Driver's License law will affect you as a teenager, you must first answer this question -- Did you obtain an instruction permit, farm permit or restricted license prior to January 1, 2010?  If the answer to that question is YES -- the GDL requirements do not apply to you (see Teen Driving Information for drivers obtaining their permit or restricted license prior to 01-01-2010 at http://www.ksrevenue.org/dmteenprior.htm ).  If the answer to that question is NO -- then all of the new requirements and restrictions shown below that take effect on January 1, 2010 are what apply to you.

 

Instruction Permit - AGES 14, 15 AND 16

  • Present acceptable proof of identity  
  • Age:  Minimum 14 years old - age proof required  
  • Testing Required:  Vision and written tests - or certificate of completion from approved Driver Education.  (Pink copy of DE-99 Form required at Renewal Station if approved Driver Education course taken.) 
  • Parental Approval Required:  Yes for 14 and 15 year olds - If under age 16, written application of parent or guardian required. 
  • Driver Education Required: No at Exam Station & Yes at Renewal Station 
  • Driving Restrictions: Licensed adult with minimum age of 21 in front seat at all times and who holds a valid driver's license with a least one year of driving experience. No person except supervising driver can be in front seat.
  • Wireless Restriction: No use of wireless communication devices except to report illegal activity or to summon medical or emergency help 
  • Passenger Restriction: No 
  • Time Required to be Held: 1 year to advance to restricted license  

 

Instruction Permit - AGE 17 AND UP

  • Present acceptable proof of identity  
  • Age: Minimum 17 years old - age proof required 
  • Testing Required: Vision and written tests or certificate of completion from approved Driver Education (Pink copy of DE-99 form required at Renewal Station) 
  • Parental Approval Required: No  
  • Driver Education Required:  No  
  • Driving Restrictions: Licensed adult in front seat at all times - minimum age 21 
  • Wireless Restriction: No 
  • Passenger Restriction: No 
  • Time Required to be Held: None 

 

Farm Permits - Age 14 and 15

  • Present acceptable proof of identity 
  • Age:  Minimum 14 years old but less than 16 - Age proof required
  • Testing Required: Vision, Written and Drive or certificate of completion from approved Driver Education (Pink copy of DE-99 & Gold copy of DE-99 required at Renewal Station if approved Driver Education course taken) 
  • Parental Approval Required: Yes 
  • Farm Affidavit Required: Yes - Must reside on a farm (parcel of land larger than 20 acres used in agricultural operations) or be employed for compensation on a farm
  • Driver Education Required:  No 
  • Instruction Permit Required:  No 
  • 50-Hour Affidavit Required:  No - must provide prior to age 16 to move to lesser restrictions 
  • Driving Restrictions:  To or from farm job, employment or other farm related work; To or from school; Anytime or anywhere with licensed adult; Over the most direct and accessible route between home and school for the purpose of attendance 
  • Wireless Restriction:  No use of wireless communication devices except to report illegal activity or to summon medical or emergency help  
  • Passenger Restriction:  May not transport any non-sibling minor passengers
  • Time Required to be Held:  At 16 will move to less restricted privileges if 50 hour affidavit has been turned in

 

Less Restricted Farm Permit Privileges - Age 16

  • Present acceptable proof of identity 
  • Age Minimum:  16 years old but less than 17 
  • Testing Required:  Vision, Written and Drive or certificate of completion from approved Driver Education (Pink copy of DE-99 & Gold copy of DE-99 required at Renewal Station if approved Driver Education course taken) 
  • Parental Approval Required:  No 
  • Driver Education Required:  No 
  • Instruction Permit Required:  No 
  • 50 Hour Affidavit Required:  Yes 
  • Driving Restrictions: Anywhere from 5:00 AM to 9:00 PM; Anytime to or from farm job, employment or other farm related work; Anytime going to or from authorized school activities; Anytime or anywhere with a licensed adult 
  • Wireless Restriction:  No use of wireless communication devices except to report illegal activity or to summon medical or emergency help 
  • Passenger Restriction:  No more than one non-sibling passenger under the age of 18 
  • Time Required to be Held:  6 months - after licensee has held the restricted Farm Permit for 6 months or until age 17, whichever occurs first, if they have complied with all laws the restrictions will no longer apply

 

 Restricted Driver’s License - Age 15

  • Present acceptable proof of identity  
  • Age Minimum:  15 years old but less than 16 
  • Testing Required: Vision  
  • Parental Approval Required:  Yes 
  • Driver Education Required:  Yes 
  • Instruction Permit Required:  Yes - must have held at least 1 year 
  • 50 Hour Affidavit Required:  No - at 15 must have at least 25 hours; must provide 50 hours prior to 16 to move to lesser restrictions 
  • Driving Restrictions:  To or from work; To or from school; Anytime or anywhere with licensed adult 
  • Wireless Restriction:  No use of wireless communication devices except to report illegal activity or to summon medical or emergency help 
  • Passenger Restriction:  May not transport any non-sibling minor passengers 
  • Time Required to be Held:  At 16 will move to less restricted privileges if 50 hour affidavit has been turned in and maintains a satisfactory driving record
      

Less Restricted Privileges - Age 16

  • Present acceptable proof of identity 
  • Age Minimum:  16 years old but less than 17 
  • Testing Required:  Vision, Written and Drive - or certificate of completion from approved Driver Education (Pink copy of DE-99 and Gold copy of DE-99 required at Renewal Station if approved Driver Education course taken) 
  • Parental Approval Required:  No 
  • Driver Education Required:  No 
  • Instruction Permit Required: Yes - must have held at least 1 year 
  • 50 Hour Affidavit Required:  Yes 
  • Driving Restrictions:  Anywhere from 5:00 AM to 9:00 PM; Anytime going to or from work; Anytime going to or from authorized school activities; Anytime or anywhere with a licensed adult 
  • Wireless Restriction:  No use of wireless communication devices except to report illegal activity or to summon medical or emergency help 
  • Passenger Restriction:  No more than one non-sibling passenger under the age of 18

Proof of Identity Acceptable Documentation

All original applicants must present one item from list A, a second item from list A, B, C or D, proof of residency and proof of principal residence address.  Applicants that were not born in the US or those that are not American citizens must provide proof of lawful presence from list B, a second item from list C or D, proof of residency and proof of principal residence address.

All applicants for renewal must present the expiring license or ID card and at least one item from list E for proof of residency and proof of principal residence address.  If they do not have the driver’s license or ID card, they must present items as though they are an applicant for a replacement driver’s license or ID card.

All applicants for a replacement driver’s license or ID card must present at least two items from list A, B, C or D for proof of identity, and at least one item from list E for proof of residency and proof of principal residence address.

A Social Security number is required from all applicants: however, it will not be used as the driver’s license or identification card number.  If a Social Security number cannot be provided documentation from list B, proving lawful presence will be required along with proof of residency and proof of principal residence address.  All documentation presented must be the original or a certified copy; no photocopies will be accepted.

A) Documentation for American Citizens or persons born in the United States:

      • Certified U.S. birth certificate (federal, state, county, Dept. of Justice) 
      • Birth Certificate from a U.S. territory (Puerto Rico, Guam, U.S. Virgin Islands, and U.S. Samoa) 
      • U.S. Passport or Passport Card (not expired) 
      • U.S. Military ID  - not expired (active duty, dependent, retired, reserve or National Guard) 
      • Certified Order of Adoption – original U.S. document 
      • Certificate of Naturalization with intact photo (Form N-550, N-570 or N-578) or Certificate of U.S. Citizenship (Form N-560, N-561 or N-645) 
      • U.S. military Common Access Card with photo, DOB, name and branch of service 
      • U.S. government-issued Consular Report of Birth Abroad 

B) Documentation for those not born in the U.S. or those that are not American Citizens:

      • Valid foreign passport with I-94 or valid “Processed for I-551” stamp with a mandated departure date greater than 60 days in the future. – No Border Crossing Cards 
      • I-94 with refugee status (passport not required) 
      • Valid I-551 Resident Alien/Permanent resident card 
      • Valid photo Employment Authorization (issued by U.S. Dept. of  Justice)

C) Documentation for Proof of name change:

      • Certified marriage certificate, U.S., city, county, state issued 
      • Certified divorce decree, U.S. with official signature 
      • Certified court order of name change, U.S. only 
      • Certified court order of adoption 
      • Marriage certificate from a foreign country – If not in English, the certificate must be translated 

D) Additional documentation to apply for a replacement Kansas Driver’s License or Identification card:

      • Valid motor vehicle registration with signature 
      • Selective Service Card with signature 
      • Valid life insurance card or policy 
      • Valid health insurance card or policy 
      • Kansas Vehicle title 
      • Diploma or GED 
      • Valid Kansas school or college identification card with photograph; or, commercially produced school yearbook with photo less than three years old 
      • Professional license 
      • Medicare identification card 
      • Student identification card 
      • Employee identification card 
      • Parole documents 
      • Medical records 
      • Kansas voter registration card 
      • Photo Driver’s License or ID previously issued by Kansas or any other state 
      • A copy of any federal or state income tax return bearing the signature of the person  
      • An identification certificate issued by the department of corrections to an offender under the supervision of the secretary of corrections 

E)  Documents for Proof of Kansas Residency and/or Proof of Residence Address - must be in the name of the applicant:

    • Kansas school forms; such as tuition invoices, receipts, class schedules, report cards, DE-99 or transcripts with the applicant’s Kansas residence address; or, school, college or university records containing the student’s name and Kansas residence address and valid school or college identification card with photograph 
    • Utility bills that display a Kansas residence address 
    • Kansas property tax bill or receipt indicating a Kansas residence address 
    • Kansas mortgage documents or homeowner insurance documents for a Kansas residence or proof of Kansas home ownership with a Kansas residence address 
    • W-2 Form not more than 18 months old with the applicant’s name and Kansas residence address 
    • Valid Kansas Motor Vehicle registration 
    • Proof of Kansas public assistance with a Kansas residence address 
    • Residential rental and/or lease agreement with a Kansas residence address, credit card statement with residence address issued within the last 90 days; checking or savings account statement within 60-days 
    • Payroll check stub issued within the last two months with imprinted residence address 
    • Original monthly bank statement not more than two months old issued by a bank with Kansas residence address 
    • Utility bill, not more than two months old, issued to the applicant (Cellular phone and pager bills are not acceptable) 
    • Current automobile, life or home owners insurance bill that includes the name and residence address of applicant (cards or policies are not accepted) 
    • Copies of school records/transcripts from a Kansas school in which the applicant is currently attending 
    • Driver’s license, learner’s permit, DMV issued identification card with photo, or renewal notice; displaying the applicant’s current residence address 
    • U.S. Postal Service change of address confirmation form or postmarked U.S. marked mail with forwarding address label (must display applicant’s name) 
    • Letter from social welfare institution (homeless shelter, battered women’s shelter, halfway house, group home, orphanage, etc.) stating applicant is resident of the facility    
    • An  identification certificate issued by the department of corrections to an offender under the supervision of the secretary of corrections containing a residence address verification
